This Privacy Policy explains how Accolend LLC, doing business as "Accolend" ("Accolend," "we," "us," or "our") collects, uses, shares, and protects information in connection with our website at https://www.accolend.com, our loan products, and our related services (collectively, the "Services").

Accolend is a direct private ("hard money") and investment-property lender serving real estate investors, brokers, and borrowers across the United States. Because we are a financial institution, some of the information we handle is subject to federal financial-privacy law, including the Gramm-Leach-Bliley Act ("GLBA"). This Policy is intended to satisfy our privacy-notice obligations; the Financial Privacy Notice section below describes how we treat nonpublic personal information.

1. Information We Collect

Information you provide to us

When you inquire about financing, submit a loan application or scenario, create an account, or otherwise communicate with us, we may collect:

  • Identifying information — name, email address, phone number, mailing address, and, where applicable, business/entity name.
  • Financial and loan-application information — Social Security number or taxpayer identification number, income and asset information, bank and financial statements, credit history and authorization to obtain credit reports, entity formation documents, and other information needed to evaluate a loan.
  • Property and transaction information — subject property address, purchase price, rehab budget, appraisal and valuation data, purchase contracts, title information, and related deal details.
  • Communications — the content of messages, forms, uploaded documents, and any information you choose to share with our team.

Information collected automatically

Like most websites, we and our service providers automatically collect certain technical information when you visit, including internet protocol (IP) address, browser type, internet service provider, referring/exit pages, date/time stamps, pages viewed, and clickstream data. We collect this through server log files, cookies, and similar technologies (see Cookies and Tracking Technologies below).

Information from third parties

We may receive information about you from consumer reporting agencies and credit bureaus, background- and fraud-check providers, brokers or referral partners who submit your information to us, and public records. We combine this with information you provide to evaluate and service loans.

2. How We Use Your Information

  • To evaluate loan inquiries and applications, underwrite, approve, fund, and service loans.
  • To verify identity and creditworthiness and to detect and prevent fraud.
  • To communicate with you about your inquiry, application, or loan, and to respond to requests.
  • To operate, maintain, secure, and improve our website and Services.
  • To send marketing and informational messages where permitted (you may opt out — see the SMS and Email sections).
  • To comply with applicable laws, regulations, and lawful requests, and to enforce our agreements.

3. How We Share Information

In addition to the financial-information sharing described above, we may share information:

  • With service providers and vendors that support our website, marketing, communications, and operations, under contracts requiring them to protect the information.
  • With professional advisors such as auditors, attorneys, and accountants.
  • In connection with a corporate transaction such as a merger, financing, acquisition, or sale of assets.
  • To comply with law, respond to legal process, or protect the rights, property, and safety of Accolend, our customers, or others.
  • With your consent or at your direction.

4. Cookies and Tracking Technologies

We use cookies and similar technologies to keep the site functioning, remember your preferences, understand how the site is used, and measure the performance of our content. Categories we use include:

  • Strictly necessary cookies that enable core site functionality.
  • Analytics cookies (for example, [Google Analytics / OTHER]) that help us understand site traffic and usage.
  • Advertising/retargeting cookies and pixels (for example, Google Ads / Meta Pixel / OpenAds) that may be used to show relevant ads on other websites and measure campaign effectiveness.

5. Your Privacy Rights

Depending on where you live, you may have rights regarding your personal information under state privacy laws (including in California, and other states with comprehensive privacy laws where Accolend operates). Subject to legal exceptions, these may include the right to:

  • Know and access the personal information we hold about you.
  • Request correction or deletion of your personal information.
  • Opt out of the "sale" or "sharing" of personal information for cross-context behavioral advertising.
  • Not receive discriminatory treatment for exercising your rights.

Note that information we collect and process to underwrite or service a loan is largely governed by GLBA and certain financial-privacy exemptions, and some state-law rights may not apply to that information. To exercise a right, contact us using the information below. We will verify your request before responding and will respond within the timeframe required by applicable law. You may use an authorized agent where the law permits.

6. SMS / Text Message Communications

Text messaging is a separate, voluntary program. If you provide your mobile number and check the SMS consent box on an Accolend form, we may send you texts about your loan inquiry, application, and servicing, and, where you separately agree, marketing. This section controls over any conflicting provision elsewhere in this Privacy Policy.

Consent is never assumed. Using our website, submitting an application, or giving us your number for another purpose does not sign you up for texts. We text only people who check the SMS consent box.

Consent is not a condition of applying for, obtaining, or servicing a loan.

Consent is collected directly by Accolend. We do not get text consent from lead vendors, list brokers, affiliates, or referral partners, and we do not text purchased or third-party lists.

Types of messages may include application status, document requests, appraisal and closing coordination, servicing notices, and, where you opt in, marketing.

Frequency and cost. Message frequency varies. Message and data rates may apply.

Opting out. Reply STOP to stop, HELP for help. Carriers are not liable for delayed or undelivered messages.

We do not sell or share mobile opt-in information or phone numbers with third parties or affiliates for their marketing purposes.

7. Email Communications

You may opt out of marketing emails at any time by clicking the "Unsubscribe" link at the bottom of any marketing email, or by contacting us. We may still send you non-marketing messages related to your inquiry, application, or loan.

8. Data Security

We maintain administrative, technical, and physical safeguards designed to protect the information we collect. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security. Please protect your account credentials and notify us if you believe your information has been compromised.

9. Data Retention

We retain personal and financial information for as long as necessary to provide the Services, service and administer loans, and comply with our legal, regulatory, tax, accounting, and recordkeeping obligations, after which we securely delete or de-identify it.

10. Children's Privacy

Our Services are intended for adults and are not directed to children. We do not knowingly collect personal information from children under 13. If you believe a child has provided us information, please contact us and we will take appropriate steps to delete it.

11. Third-Party Websites

Our website may link to third-party sites we do not control. This Policy does not apply to those sites, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any site you visit.

12. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above and, where required, provide additional notice. Your continued use of the Services after an update indicates your acceptance of the revised Policy.
